Total Well Connect — Terms & Conditions

Welcome to Total Well Connect. These Terms & Conditions ("Terms") are a binding agreement between you and Total Well Connect ("TWC," "we," "our," "us") and govern your access to and use of our website, membership platform, tools, digital library, community, and related services (collectively, the "Services").
By creating an account, purchasing a membership, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Who We Are: A Network, Not a Provider
Total Well Connect is a membership network. We connect members to a curated directory of independent third-party partners — including functional medicine and telehealth providers, a licensed insurance agency, compounding and pharmacy partners, lab and diagnostic services, and other wellness resources — along with member tools, educational content, a digital library, and a private community.
TWC is not a healthcare provider, medical practice, pharmacy, insurer, or insurance agency. We do not provide medical care, prescribe, diagnose, dispense medication, or sell or administer insurance.
Our network partners are separate, independent companies with their own terms, pricing, and policies. Your relationship with any partner — including any consult, prescription, lab, program, purchase, or insurance quote — is solely between you and that partner.
TWC does not control and is not responsible for the products, services, advice, acts, or omissions of any partner. We do not guarantee any partner's availability, pricing, results, or outcomes.
2. No Medical, Insurance, Legal, or Financial Advice
Nothing provided through the Services is medical, health, diagnostic, treatment, legal, financial, tax, or insurance advice. The Services — including our content, tools, calculators, digital library, educational materials, and community discussions — are for general informational and educational purposes only and are not a substitute for professional care.
Always consult a qualified, licensed professional before making decisions about your health, medications, treatments, or coverage. Never disregard or delay seeking professional advice because of something you read or accessed through the Services. Any action you take based on the Services is at your own discretion and risk. In an emergency, call your local emergency number.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and current.
4. Accounts & Registration
To access member features, you must create an account. You agree to:
provide accurate, complete information and keep it updated;
keep your login credentials confidential; and
accept responsibility for all activity under your account.
Notify us promptly at info@totalwellconnect.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other members.
5. Membership, Billing & Auto-Renewal
Membership. Access to certain features requires a paid membership (for example, our $15/month membership). Current pricing and features are described at the point of sign-up.
Recurring billing & auto-renewal. Memberships are subscriptions that automatically renew for successive billing periods (e.g., monthly) at the then-current rate, using your selected payment method, until you cancel. By enrolling, you authorize us and our payment processors to charge your payment method on a recurring basis.
Payment processing. Payments are handled by third-party processors (such as Stripe, PayPal, or Squarespace Payments). We do not store your full payment card number. You agree to their applicable terms.
Price changes. We may change membership pricing or features. We will provide notice of material changes as required by law, and changes apply to your next billing cycle. Your continued membership after the change takes effect constitutes acceptance.
6. Cancellation & Refunds
Cancellation. You may cancel your membership at any time through your account settings or by contacting info@totalwellconnect.com. Cancellation stops future renewals; your access continues through the end of the current paid billing period.
Refunds. Except where required by applicable law, membership fees are non-refundable, and we do not provide refunds or credits for partial billing periods or unused access. Fees, pricing, and purchases for any network partner are governed solely by that partner's own refund and cancellation policies.
7. Network Partners, Affiliate Links & Third-Party Services
The Services contain connections, referrals, and links to independent partners and other third-party websites, products, and services.
These third parties operate independently and under their own terms and privacy policies.
TWC is not a party to and is not responsible for any transaction, agreement, product, or service between you and a partner.
TWC may earn commissions from certain affiliate links or partner referrals. This does not add cost to you and does not change the independence of those partners.
We do not endorse, warrant, or assume responsibility for any third-party content or offering. Review each third party's terms before engaging.
8. Acceptable Use & Community Conduct
You agree not to:
violate any law or these Terms, or infringe the rights of others;
post or share content that is unlawful, harmful, harassing, defamatory, hateful, fraudulent, or that contains others' private or sensitive information without consent;
share medical, dosing, or treatment instructions as if they were professional advice, or solicit or facilitate the purchase of unlawful products;
impersonate any person or misrepresent your affiliation;
upload viruses or malicious code, attempt to gain unauthorized access, scrape, or disrupt the Services;
use the Services to advertise, spam, or solicit other members without permission; or
use the Services in any way that could harm TWC, its members, or its partners.
We may remove content and suspend or terminate access for any violation, at our discretion.
9. User Content & License
Your content. You retain ownership of the content you submit (such as posts, comments, and messages). By submitting content, you grant TWC a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content as necessary to operate and promote the Services. You represent that you have the rights to the content you submit.
Community content is public to members. Content you share in community areas may be visible to other members. Do not post sensitive personal or health information you wish to keep private. You are solely responsible for what you choose to share, and TWC is not responsible for how other users use it.
Feedback. If you send us ideas or suggestions, you grant us the right to use them without restriction or compensation.
10. Intellectual Property
The Services and all related content, branding, logos, text, graphics, tools, and software (excluding user content and third-party content) are owned by TWC or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use as a member. You may not copy, reproduce, distribute, resell, or create derivative works from our content without our prior written permission.
11. SMS / Text Messaging
If you opt in to SMS, you agree to the messaging terms described in our Privacy Policy, including that message frequency varies, message and data rates may apply, and you can opt out anytime by replying STOP (or HELP for help). Opting out of SMS does not cancel your membership or other communications.
12. Disclaimers of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content, tool, or partner connection will meet your expectations or produce any particular result. You assume full responsibility for any decisions you make regarding your health, wellness, finances, or insurance.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TWC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR ANY PARTNER, EVEN IF ADVISED OF THE POSSIBILITY. TWC'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TWC IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless TWC and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, your dealings with any partner, or your violation of these Terms or any law or third-party right.
15. Dispute Resolution, Arbitration & Governing Law
Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing any claim, you agree to contact us at info@totalwellconnect.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration & class-action waiver. Except for small-claims matters and claims for injunctive relief, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, and not in a class, collective, or representative action. You and TWC waive the right to a jury trial. (This provision significantly affects your rights — please review it carefully, and see the note below about confirming it with counsel.)
16. Termination
You may stop using the Services at any time and cancel your membership as described in Section 6. We may suspend or terminate your access, with or without notice, for any violation of these Terms or for any conduct we reasonably believe is harmful. Provisions that by their nature should survive termination (including Sections 2, 7, and 9–15) will survive.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new "Last Updated" date, and material changes may be communicated where required. Your continued use of the Services after the changes take effect constitutes acceptance.
18. General
These Terms, together with our Privacy Policy, are the entire agreement between you and TWC regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
